Impact of Managers and Leaders in Organizations on the Motivation of Employees Essay

Any organization is always started with an elaborated target to fulfill based on arrangement and strategies to be applied in the performance of achieving those goals. Actually the objective, performance and the methodology in which the organization is set up and run, defines its kind and capability in relation to other organizations. Organization consists of staffs that are categorized depending on the duty performed and the responsibilities that are bestowed upon them. In order to achieve success an organized system is essential which will involve a specified hierarchy which clearly positions each and every individual in relation to the capacity and the type of responsibilities. Under this arrangement management and leadership are considered to be the key factors in accomplishing the targets. Management comprises duties that fully covers directly or indirectly the whole structure of the organization. It combines aspects like controlling all the operations of the company inclusive of planning events, strategic steps to be followed and even the necessary concepts that improves the organization. Management is also involved in the overall organization of the available resources that are associated with the whole operation. Management determines the kind of employees working in an organization which is brought about by the coordination and leadership that is developed towards the employees. All the functions of management are carried out by the managers in the organization. Leadership and management are related terminologies and they are inseparable in the sense that managers also play the role of leadership. A leader focuses mostly on the directives to be followed by the employers in the effectiveness of their duties. This is mostly done in an interactive method and understanding the factors that affect or hinder the achievements. Both managers and leaders play an important role in motivating their employees. Despite the fact that the employees may clearly understand their responsibilities and duties in the organization, fully desirable outcomes may be affected by lack of motivation. According to (Geary, D. C. (2005)) motivation is a key factor in influencing someone to desire to add extra effort to improve the work and achieve more than expected. Through the coordination of mind motivation also promotes the inward generation of will power which alternatively has a considerable physical contribution to human body. Depending on the type of organization leaders and managers may apply different methods in motivating the employees. Some of the ways used by managers in motivation are like organizing functions which include honoring and rewarding specific employees following their best performance. This is a common method but it enhances the spirit of positive competition amongst the employees. Satisfaction is another means applied by managers to motivate employees. A satisfied employee will have more will to work. Career and talents recognition which is mostly applied by leaders to appreciate their employees plays a part in motivating them. Leaders on the other hand recommend the promotion of hard working employees to the management which also motivates the employees. Some managers have introduced a systematic salary increase which may be annual or after a specified period. This does not necessary depend on the profit made by the company but on the period spent by the employee working in the company. Bonuses and commissions on the other hand are sometimes measured against the benefits realized by the organization within a specified duration. These are among factors of motivating the employees. Following the performance and the leadership portrayed by the leader which is mostly done through leading examples, employees feel motivated and the admiration of copying the good examples of their leaders is enhanced. In an attempt to elaborate motivation and the effects, several theories have been put forward. In this paper few theories have been borrowed to expand further the contribution of motivation. According to (Kahneman and Miller (1986)) Our human behavior will be more or less be influenced by the attitudes towards certain subjects, determinations and the capacity of attaining a specified responsibility will highly depend on the feeling of the inward drive. This is clearly elaborated in the attitude-behavior consistency theory. Leaders attempt to learn the attitude of their employee through the interaction and knowing their behaviors in which they often know or decide on the way to motivate them. They also have the responsibility in influencing their employee’s attitude may be towards the organizations strategies. Consistency theory of motivation attempts to elaborate that individuals mostly achieve their motives through distinguished coordination of the willingness and the capability to perform. Employees will always feel motivated under the circumstances in which leaders and managers create a conducive environment for them to integrate their capability led by the will to perform these responsibilities. According to (Milgram, S. , 1983) a considerable situation of the capability of the employee is essential to be applied by the managers in order to clearly understand and develop the right methods in motivating the employees. According to (Adams, J. Stacey, 1965), another theory of motivation is the equity theory. This theory dwells mostly as the appreciation done to the employees through the rewards. Considerations are always important in the determination of the employees who may be rewarded according to their contribution. It’s common that rewards differ according to the quantified duties well done by the individual employee or a group. Satisfaction of the employees is always determined by the reward attained as deserved. De-motivation is likely to occur if the distribution of rewards does not match with the effort applied in the achievements. Expectancy theory clearly defines a reason which contributes to the motivation of employees. According to (Deci, E. L. & Ryan, R. M. , 1991) either on the reliance on the previous experience in the organization or through the organization procedure, the employee will add a lot of effort in relation to the reward expected. In other words employees may improve greatly on their duties under the influence of the targeted reward which they expect to get after achieving their goals. Similar to expectations of the management towards achievements of the organizational goals, employees expects the full support from the management. This can be brought about by the keen consideration of the responsibility of the employees as previously discussed employees will aim at fulfilling their duties following the attention from the management and leaders who have the responsibility of giving correct directives. motivated employees will therefore feel to be fairly treated after being rewarded from their effort according to how much they achieved. This will therefore combine and relate equity theory and expectancy theory of motivation as discussed. Following the fact that success is among the most important goal in an organization, it is important for managers and leaders to subject their efforts in order to achieve it. In order to attain success they have to depend on their employees. In other words the performance of the employees will therefore depend on the management and leadership in the organization. One of the impacts of motivation to employees is the increase in productivity. Right motivation from the managers and leaders will cause the employees to be more active and potential which will be implemented in their duties. Motivation from the managers to their employees has also been associated with the expansion and the growth of the organization. Motivated employees will always do a quality job which can have a distinguished difference when compared with the competitors. In such a situation the intended or the targeted client will focus more on that specific organization and in return the growth of the organization will be realized. Positively motivated employee will be more innovative and they will be able to contribute to the teamwork in an organization hence minimizing the unexpected pull back which may be brought about by the lack of cooperation. Creativity will also be enhanced and this will contribute a lot in coming up with the new ideas. Sustainability of employees has been a difficult and a challenge to many organizations. This is brought about by the fact that employees need satisfaction while undertaking their duties. Managers in collaboration with leaders successfully overcome the challenges of employee sustainability through positive motivation to their employees and they eventually find that they critically reduce the level of day to day recruitment of new staff to replace the ones who have resigned. This will also improve the work that is done due to the experience gained by the employees they can comfortably and undoubtedly implement it. Motivated employees become devoted to their duties and responsibility in the organization thereby reducing the errors and careless mistakes which would reduce the credibility of the organization. Though it’s a complex exercise if the managers maximize on motivating their employees they will also in return contribute directly or indirectly to simplifying the manager’s duties of planning, controlling and coordinating the organization which is contrary to de-motivated employees. The leaders on the other hand will have more room to improve their initiatives and efficiency. Irrespective of the type and the size of the organization, motivation to the employees stands to be a key factor in the achievement of goals. Considering example of institutes like universities, learning centers, production centers and others, It is through the aspect of motivation to the employees that their abilities attitudes and their interest can be utilized which will in return promote the organization name both locally and internationally. In most parts of the world most organization has reportedly realized their goals through the hard work and coordination attributed to the employees. Following this good and improved performance there has always been a system of motivating the employees through the integrative and collaborative methods put forward by the managers and leaders. According to the chairman and chief executive officer of Coca-Cola Company Mr. Neville Isdell, the company has realized positive performance and success due to good and favorable conditions which of cause have been brought about by the cooperation of the employees and commitment. This can otherwise be affected if the employees are de-motivated hence this is a good example of the impact of managers and leaders on the motivation of their employee. Conclusion In every organization, the concept of motivation by the managers and leaders to their employees has accounted to tremendous success to many organizations through the increased productivity of the organization, expansion and growth of the organization, satisfied and lively employees, minimization of errors and accidents and so on. It has been noted also that there are several methods and ways in which the employees are motivated. It is therefore the responsibility of the leaders and mangers to fully involve themselves in practical consideration of the performance of their employee’s and the necessary improvements required. Motivation is a more complex exercise but the devotional strategies that may be applied by the leaders and managers are essential to achieve the positive outcomes.

Miss Essay

A simple break in the chain of infection by always using the Standard Infection Control Precautions (SICPs) can save the NHS thousands of pounds every year not to mention saving patients’ lives. Cleanliness Champions have been put in place to make sure Standard Infection Control Precautions are implemented within health care settings. MRSA (Meticillin-resistant Staphylococcus Aureus) is one example of the staphylococcus family common bacteria (BBC Health–MRSA). There are many strains of MRSA and many people carry it in their throat, nose and skin folds. MRSA is an infectious agent and can live on the body for example in eczema, varicose and decubitus ulcers, this acts like a reservoir providing ideal conditions for the MRSA to lie in skin folds and in wounds. For the bacteria to exit the portal it can simple be spread from skin to skin contact. To break the chain of infection the patient should wash their hands. However, not practising good hygiene gives the bacteria a means of transmission. The bacteria will wait for a portal of entry; this could be another patient touching contaminated skin. There have been a number of campaigns to eradicate the transmission of MRSA, and one of them is from the World Health Organisation â€Å"Save lives clean your hands†. This campaign is for Health Care workers to assess within their own departments how often hand hygiene is being carried out by their colleagues (WHO 2012). Hand hygiene is considered one of the most effective measures in reducing and preventing the incidence of avoidable illness, in particular HAI. All staff within health care settings should be aware of this and perform hand hygiene effectively and in a timely fashion (Health Protection Scotland (HPS) May 2009). There are three main types of hand hygiene. Social Hand Hygiene which involves using soap and water. Hygienic Hand Hygiene is using antiseptic hand cleansers from a soap dispenser and then there is Surgical Scrub which involves scrubbing the hands and forearms with antiseptic cleansers. Each hand decontamination process uses a seven step technique. The 5 moments for hand hygiene guidelines explain when hand hygiene should be used (WHO 2009). PPE (Personal Protective Equipment) can also be used to protect against HAIs. PPE consists of gloves, aprons, face masks and goggles. When dealing with potential infections a risk assessment should be done before dealing with the threat of the infection being transmitted. The risk assessment should include whether or not you may need to wear gloves or aprons. Eye protection should be used for theatre staff due to a huge potential of blood splashes. Sharps include needles, scalpels, stitch cutters, glass ampoules and any sharp instrument. The main hazards of a sharps injury are hepatitis B, hepatitis C and HIV. (Royal College of Nursing 2005). All sharps must be handled and used with a great deal of care and disposed of according to the Standard Infection Control Precautions (SICPs). If there has been an incident of a needle stick injury it must be reported and documented as required. All in all the Cleanliness Champions programme will help Health Care workers understand the importance of Infection control and hopefully it will create new generation of Nurses who will be vigilant to how important hand hygiene is. Career Development Within A Company

Career Development Within A Company In all organisations, irrespective of their structure, the employees have aspirations to advance and grow in their organisation, and also a desire to achieve a sense of fulfilment. Unless these aspirations and desires of employees are taken care of, the organisation cannot move to higher level of efficiency and productivity. The strength and vitality of any organisation much depends on the fact that whether its employees are convinced that they are taken care of, not only in financial and other tangible terms but also emotionally and mentally. A well thought-out system of career planning is one way of achieving this organisational objective. An organisation without proper career planning and career development initiatives is more likely to face the high attrition rate, affecting all its plans and programmes and causing a lot of harm. Without succession planning, manning of vacancies at higher levels becomes difficult. Therefore, effective HRP encompasses career planning, career deve lopment and succession planning. With the advent of rapid technological advancement, organisations are be-sighed with manpower redundancy and concurrently equally concerned with the problem of retention. On the other hand, organisations need to address career development need of employees that mostly revolves around individuals by taking care of proper career planning and career management system. With the given scenario, since success of manpower planning much depends upon career planning, there cannot be effective manpower planning, if there is ineffective career planning in the organisation. In other words, career planning is an integral part of the manpower planning that affects business strategy and corporate planning. The Concept and definition of Career planning Career is viewed as a bunch or collection of jobs or positions. Generally, it describes an applicable career path within the structure of the organization. Basically, it shows the principal personnel development paths within the organization. Career is defined in the Oxford English Dictionary as a person’s â€Å"course or progress through life or a distinct portion of life†. Usually, it is referred to remunerative work and sometimes also formal education. The etymology of the term derived from the Latin word career, which means race. All the jobs, that are held together during one’s working life, constitute career. It is also viewed as the sequence of positions held by an individual during the course of his employment life. Edwin B. Flippo defined a career, as a sequence of separate but related work activities that provide continuity, order and meaning in a person’s life. A career may be viewed as amalgamation of the changes in values, attitudes and motivation an individual embrace, as he or she grows older. This constitute subjective element of the concept â€Å"career†. Greenhaus and Schein described several themes underlying different definition of career as : The property of an occupation or organisation: In this way the career describes the occupation itself or an employee’s tenure within an organisation. Advancement: It denotes the progression and increase in success an individual receives within an occupation or organisation. Status of a profession: In this sense, career is used to distinguish different profession. Such as engineering, medical profession is different from other occupation like plumbing carpentry etc. The former is said to have a career where the latter does not have.

Ameican wilderness Essay Example | Topics and Well Written Essays - 1000 words

Ameican wilderness - Essay Example In the given paper will discuss the records of the two governors of early American colonies. William Bradford (1590-1657) is known as an American colonial ruler and a Pilgrim head. He became famous due to great number of facts. The most important achievements of Bradford are the foundation of Plymouth Colony and the establishing peaceful relations with Native Americans (Perkins, 2006). The record of William Bradford tells us about the Pilgrims’ arrival in 1620: â€Å"being thus arrived in a good harbor and brought safe to land, they fell upon their knees & blessed ye God of heaven, who had brought them over ye vast & furious ocean, and delivered them from all ye perils & miseries thereof, again to set their feet on ye firmer and stable earth, their proper element† (Bradford (Edited by Samuel Eliot Morison, 1967) Their primary goal was to find a place where they would become independent in their religious belief. Pilgrims considered Virginia to be a right place for them. However, they arrived in the place where there was no government, so they had to form it. M ayflower Compact, a document created by Pilgrims, became a record of the new laws and William Bradford was appointed as a leader. From the Bradford’s record we find out that the new conditions differed much from the life the Pilgrims got used to. It was very difficult for people to survive the first winter, which was extremely cold. Bradford understood that the help of Native Americans was essential, so he established the agreement with the Wamponoag tribe head. This tribe was one of the friendly tribes, which helped new Americans adopt to the new life. Bradford was the organizer of the first Thanksgiving Day held in order to thank Native Americans for their help. Bradford wrote in his records, that â€Å"†¦and no marvel if they were thus joyful, seeing wise  Seneca  was so affected with sailing a few miles on ye coast of his own  Italy; as he affirmed, that he had rather

Exam questions - Essay Example If the right is bought, it is called a long call; if the right is sold, it is called a short call. An option that gives the right in due course make a sale at a predetermined price is called a "put" option. If the right is bought, it is called a long put; if the right is sold, it is called a short put. i) Flexibility - Options are an extremely flexible tool. Options can be bought or sold in many different combinations for many different investment opportunities (i.e. Stocks, indices) . This allows for an investor to take advantage of varied market conditions available at a time. Options can be traded to address rising or declining markets, quiet markets or volatile markets with uncertain price directions. ii) Increased trading opportunities – There are a great number of strategies that can be adopted while trading options. These create additional profit and risk management opportunities for traders thus an increase in returns. iii) Limited risk with unlimited profits – If one buys a call option, they benefit from unlimited profit potential as the stock moves higher while the investor who buys a put option, has the benefit of unlimited profit potential as the stock moves lower. Index options are financial derivatives that give the possessor the right, but not the obligation, to buy or sell a basket of stocks, such as the Nasdaq – 100 index options, at an agreed-upon price and before a certain date. An index option is comparable to other options contracts, the difference being the underlying instruments are indexes. One may use index options to hedge when there is need to protect the value of the portfolio of mixed stocks in case of a market decline. Index puts are utilised in this instance. Index puts are generally used to protect unrealised profits stemming from an investor’s portfolio. There may be various classes of options that are available

Organizational behavior - interpersonal skills and managerial roles Essay

Organizational behavior - interpersonal skills and managerial roles - Essay Example The four functions of management are planning, organizing, leading, and controlling. Planning implies setting objectives and identifies the actions that must be performed to achieve the objectives (Schermerhorn, et al. 2003). Organizing involves dividing work structures into individual tasks and arranging the organizational resources to accomplish those tasks. Leading refers to the act of creating enthusiasm among the workers so that they work hard to accomplish tasks successfully (Schermerhorn, et al. 2003). Controlling is related to the act of monitoring the performance of the employees and taking corrective action whenever necessary. All the managerial functions are equally important. An important interpersonal skill that a manager must possess is good communication skills. The manager must be good at both written and verbal communication. He must use verbal communication to inspire and motivate the workers to achieve a higher level of performance. Employees that are properly motivated by the manager are more productive. A manager can motivate an employee by using intrinsic and extrinsic rewards. An example of an intrinsic reward is telling an employee he did a good job on a task, while an example of an extrinsic reward is offering a financial incentive such as a bonus. Managers must be good active listeners. â€Å"To listen means we not only understand what you have to say, we can practically apply your thought process back to you† (Nelson, 1995). They must have great writing skills because managers are required to write reports for the different stakeholders group of the company which includes lenders, suppliers, investors, employees, government, and the board of directors. Three essential skills that a manager must possess are technical skill, human skill, and emotional intelligence. Human skills refer to the ability to work well with

Gone With The Wind Essay Example | Topics and Well Written Essays - 750 words

Gone With The Wind - Essay Example In this story, the main character, Scarlett O’Hara, must come to grips with the loss of her childhood wealth and comfort as a true Southern Belle of the Old South as the Civil War rips apart the Georgia countryside of her home and renders her penniless in the devastation of the Antebellum South. This is an important distinction that is made much of in both the book and the subsequent film. At the beginning of the novel, the grandness of the plantation does not seem to equal later impressions of it. Scarlett herself doesn’t seem to really being placing the mansion and grounds into their sweeping concepts until somewhat later in the book, when the city of Atlanta is under siege. It is here that she begins considering â€Å"the sprawling white house with fluttering white curtains at the windows, the thick clover on the lawn with the bees busy in it, the little black boy on the front steps shooing the ducks and turkeys from the flowerbeds, the serene red fields and the miles and miles of cotton turning white in the sun!† (339). As the war rages on and Scarlett is forced to exist in the relative squalor and deprivation of the Reconstruction, these images become even more distanced from the real. For example, Rhett Butler decides to leave Scarlett to her misery as he goes to â€Å"hunt in old towns and old countries where some of the old time must still linge r† (1009) while Scarlett continues to place her memories of the old plantation in terms of the romantically idealized: â€Å"the banks of cape jessamine bushes, vivid green against the white walls, the fluttering white curtains† (1011). The ending impression of Tara before the war thus takes on the image that is eventually put forward at the opening of the film by the same name. For the film, it was important to portray the sprawling wealth of a southern plantation to explain both Scarlett’s headstrong, princess-like attitude as well as her expectations regarding other people’s behavior. The mansion

The Battle of Midway - A Naval Analysis Research Paper

The Battle of Midway - A Naval Analysis - Research Paper Example In essence, this combat was at Midway atoll which was a mid-pacific naval base because of the high water tower visible in the area. In the past, Japan portrayed prowess over the US navy hence making them strike any where that they chose to without seeking consent from the US navy. However, The Battle of Midway created an equal platter for the two naval entities to take deemed offensiveness on one another. With these shallow facts presented, this essay will investigate the Battle of Midway and the significance it had on the historic past of the United States. Background information Primarily, Japan had strong convictions about eliminating US control over the greater Pacific region as a way of allowing themselves to create a larger Asian sphere for prosperity. For them, taking war to the Americans meant that Japan had demoralized them through defeat as a way of gaining upper recognition in the Pacific war. As part of their plan, Japan intended to lure US aircraft fleets into a trap tha t would allow them to be occupants of Midway on US soil. This action drew influence from the Doolittle Raid that made Japan cautious that facilitated the expansion of their perimeter defense area. However, the operation failed miserably because the US navy broke Japanese naval codes that provided information on the time and location of their deliberated attack 1. In essence, Japan intended to use Midway as a potential combat location that would have furthered attacks n Islands like Fiji and Samoa. In this regard, the forewarning enabled assisted the US in their setting up of a successful ambush of four out of six aircraft carriers as a vengeance plot for their own carriers attacked by Japan. Japanese battle plan As history would present it, the attack mission was under the able leadership of Admiral Yamamoto Isoroku that focused on winning the US over as they had done to Malaya, Phillipines, and Indonesia. However, there resulted internal wrangles between the Imperial Army and the N avy that led to delayed plans for the attack. In due time, the conflict achieved solutions as Yamamoto threatened to resign citing no cooperation from their counterparts. Finally, the two war agencies adopted his hatched plan to the latter. Essentially, Yamamoto was for the idea of destroying US aircraft forces as the country served as the primary hurdle to conquering the pacific. Moreover, the heightening of this concern drew influence from the Doolittle Raid of April 18, 1942 where US targets bombed Japanese cities. From this attack, the Japanese viewed American carriers as merciless threats as they were able to penetrate their territory with ease that tormented the Japanese psychologically. In his attack plan, Yamamoto intended to knock down defenses that existed in Midway and then establish a Japanese owned airbase there. The plan included an assault attack led by Deputy Admiral Nagumo Chuichi and his aircraft carrier from the North West. This would have weakened the forces of d efense in Midway to facilitate a strike on US warships. Next in the battle aircraft line would be a battleship with Admiral Yamamoto on-board who was to be the heavy Ferrier of gun powder essential for the war. Additionally, vice admiral Kondo Nobutake was to come from the southwestern and the western side whose role in the battle of Midway was to secure the area

Ambassador for Ethopia paper Term Example | Topics and Well Written Essays - 500 words

Ambassador for Ethopia - Term Paper Example Religious allegiances of Ethiopian population are generally mixed, with Orthodox Christianity being followed by 43,5% of religious population, with different forms of Islamic faith (33,9%) and Protestant Christian churches (18,6%) being the second and the third most popular confessions, respectively (â€Å"Ethiopia†, 2011). As regards population density, it should be noted that it amounts to 186/sq. mi, and therefore Ethiopia ranks as the 123rd by population density among the nations of the world. The annual population growth of Ethiopia exceeds 3.194%, with 42.99 births/1,000 population (â€Å"Ethiopia†, 2011). This would make Ethiopia 8th among the world’s countries by population growth and 6th by birth rate, respectively. Total fertility rate equals 6,02 children born/woman. However, the extremely high infant mortality level (77.12 deaths/1,000 live births) definitely presents a difficulty to further demographic development and stabilization of the country, wh ile life expectancy at birth amounts to mere 56.19 years (â€Å"Ethiopia†, 2011).

Investigating the effects of heat treatment on metals Essay Example for Free

Investigating the effects of heat treatment on metals Essay Metals have various uses in a wide range of industry, where the properties of each metal determine what the metal will be used for. When a metal properties need to be changed to satisfy particular needs, it can be modified by processing the metals with treatments such as cold working and heat treatments. Structure of metals Metals are made from their ore, at extremely high temperature. In this form, metals are in a liquid form. The liquid metals are cast by pouring it into moulds where it is cools down and solidifies. When metals are frozen, crystals start forming. These crystals begin to form throughout the metal, where they keep they keep rapidly growing until they reach a neighboring growing crystal structure. These crystals are called grains, where crystals that meet with one another are called grain boundary. Dislocation Dislocation are formed when defects are found in the crystal structures. This is often caused by when atoms are missing in a layer, This is shown in figure one. Secondly, the metal trip should be placed on top of the hottest part of bunsen burner. The metal should be kept there until is is seen glowing red. Once the metal has gone red, it should immediately be plunged into the previously filled beaker in step 1. Lastly swirl the beaker vigorously for thirty seconds. Tempering With any metal strip that has been quenched, place the strip unto a bunsen flamer until the metal strip goes a dull red. Once the metal has gone dull red, slowly remove the metal from the bunsen flame and pace on a heat proof mat, where it should be left to cool to room temperature. Annealing Firstly, heat metal strip for five minutes on the hottest part of bunsen flame. the whole length should of the strip metal should be heated. Next, half close the bunsen flame and continue heating the metal on the non luminous flame. When a minute or two has passed, starting moving the metal strip in and out of the flame, top start cooling down the metal. After a couple of minutes, remove the strip from the flame and place it on a heat proof mat, where it can cool to room temperature. Cold working Once the metal has been cooled down, a marker should be made 30mm from the tip of the metal suing a felt tip pen. The shorter end of the metal strip should then be put in between two wooden blocks(the marker line should still be visible). The wooden blocks should be clamped firmly on the table or bench to keep the two blocks in place. With leather gloves, bend the metal strip through 90 degrees where the strip is lying alongside the wooden block ( shown in picture B). The metal should be bending where the marker was made. Now the metal should be bent 180 degrees from its position, this is shown in picture C. This in total counts as two bends. To conclude, the strongest metal in the cold working was steel where it snapped after 44 bends. This changed when the metals where quenched, copper showed the most significant change, where the metal bent 64 times before snapping; indicating an increase in strength of copper. Significant changes was also present in aluminum. Quenching on the other hand had very little affect on steel, as the data shows that steel bent 43, slight decrease compared to cold working where the steel bent on average 44 times. Overall the most affected by quenching was copper, followed closely by aluminum, with the lowest being aluminum which has broke on average after 42 bends. In annealing, copper by far was the strongest metal where the average number of bends was 75. Aluminum and steel however, only bent 32 and 35 times, respectively. This shows that annealing heat treatment does little in increasing the strength of steel and aluminum. The heat treatment tempering, managed to increase the strength of copper and aluminum by a large margin, compared to the other two treatments. This indicates that tempering may be the best heat treatment due to it making copper bend on average 84 times and aluminum 64 times, which are the highest average for both metals. The strength of steel on the other hand decreased under tempering. Generally, aluminum showed the most changes on all three treatment, with tempering having the most effect. Copper strength also increased under all heat treatment, with it also showing the most significant change under tempering. Steel however, was either unaffected or decreased under all heat treatments, this may due to experimental errors Evaluation The procedure for each metal on the table above was repeated three times, to ensure that the experiment was reliable. New strips of metals were used for each new treatment to ensure that the accuracy of the results is not changed. In addition, the length was each metal was made the same, to make the results valid. The metals also needs to be bent as close to the strip as possible, as bending the strips to far may cause the metal to bend quicker, affecting the accuracy of the results.

Impacts Of Tourism On Natural Environment And Tourism Tourism Essay

Impacts Of Tourism On Natural Environment And Tourism Tourism Essay Before elaborating the relativity of Tourism and Environment, it is necessary to understand both terms individually. Relativity is to distinguish contrast and characterise between two different values for understanding their dependability upon each other. Tourism: Tourism is now a phenomenon, not just a simple holiday activity. It also has to be considered that tourism and tourist are two different characteristics. Approaches differentiate accordingly and it can be defined according to both understandings: It [tourism] is a human activity which encompasses human behaviour, use of resources, and interaction with other people, economies and environments. Bull, 1991:1 cited in Holden, A. (2008). From mentioned definition tourism is mainly focused on natural or social aspects, where author has examined tourism on the basis of environmental characteristics. Another understanding could be from the perspective of a visitor or tourist, again I would like to mention a definition from Holdens writing; where he used another authors definition to differentiate from the previous point of view. Tourism as: an attitude to the world or a way of seeing the world, not necessarily what we find only at the end of a long and arduous journey Franklin, 2003:33 cited in Holden, A. (2008). This definition is from the perspective of a tourist as a single entity and more individualistic. Here personal experience is more valuable for a consumer. Tourism is not a very old study for world but travel defiantly is. Tourism is more of gaining an exceptional experience than a regular living, while travel can consists of various reasons behind it. But according to Hunter and Green (1995, pp: 1) There is no universally accepted definition of tourism. This is not surprising, since what constitutes a tourist and the tourism industry are still matters of debate. Environment: In terms of tourism, Environment is always understood as a nature or atmosphere of a destination or a place which is used for tourism. Nature consists of mountains, water resources such as sea side, sea, rivers, waterfalls etc. Green environment includes plants, forests, parks, rainforests, safaris etc. when elaborated to wilderness it consists wild life, animals, forest species and so on. Socially; heritage sites or cultural uniqueness is also a part of an environment. In environmental studies it has commonly been assumed that there exists a fundamental connection between a societys management of natural resources and its perception of nature. Brunn and Kalland (1995:1) cited in Holden, A. (2008). Environmental studies and explanations are vast and distributions of its characteristics are crucial. If we look at it from a different perspective it seems environment consists of whole world (living or non living beings) including humans, animals, plants and resources. From evolution humans are using environmental resources. When observed this use or loss, it is categorised as Environmental study. Resistance and Resilience are two distinctions in this study, where Resistance is tolerance of the site (while getting used and still being undisturbed) and Resilience is the ability to recover from the happened loss or change. Some sites have either qualities or some not. Hence due to its characteristics, Hunter and Green (1995) stated that environment can be subdivided into three components as the physical environment or a biotic environment which includes solar energy, soil, water and climate. Tourism and Environment are interdependent: Tourism is based on the environment; Tourism has and will always devour the natural resources. Tourism is the main factor carrying out the natural environment in both positive and negative aspect. Even simplest form of tourism like visiting a zoo consumes environmental resources such as animals, birds or plants. Such a kind simple form of tourism also renders constructive as well as unconstructive effects. The negative effect cases might be the capturing animals from their natural habitat and keeping them in a zoo, whereas positive aspect can be that by capturing the animals they are getting protected against hunters and other environmental conditions that can be critical to them. In various other smaller or greater impressions tourism has both negative and positive effects, but more important is to understand the actual destruction or refurbishments causing from tourism towards environment. It is understandable that human involvement with environment tend to use the resources, if it cant help to make them grow at least they can be saved from future damages by use of intelligent human behaviour. Study of tourism environment is about understanding the cause and effect rule and to imply theories to protect the environmental loss due to mass tourism. It is also significant that Tourism should place along with the higher quality of environment and environment shall get benefit from it not the damage. No doubt every human action has its own pros and cons and fragility of nature resources must not be seriously harm by it. Tourism is without a doubt among the worlds highest profitable industries (whether on the cost of environment) and relationship between tourism and environment can get equilibrate if financial profits gets used for the conservation programs or environmental sustainability. Impacts of Tourism on environment: All activities consume resources and produce waste, possibly all these activities has a potential to spoil the environment, and in same context Tourism is no exception. Tourism has developed as a largest industry and any activity happens at a mass level definitely leaves its positive and negative impacts, such as tourism did in the past. Although not the case that every environmental problem is produced by tourism but still being a mass industry it affects on a wider platform. Negative Impacts: The harmful impact of tourism can destroy the natural environment when the negative impacts on the environment are sufficiently intensive and extensive. Such as damaging biodiversity of particular areas which includes holiday retreats, clearing of vegetation for constructing resorts and hotels or other tourism facilities, and also many rare species have been brought to the verge of disappearance due to non-tourism nuisance which are directly related to tourism. Habitat devastation brought by unrestrained and ill planned tourism is the prime cause of extinction of species which eventually destroy the natural balance, but destruction of biodiversity can have far reaching effects than this. Another negative impact is the depletion of natural resources like water, land and resources like food, energy or raw materials etc. which are already in short supply. Degradation of land resources like wood or plantations is another example of the negative impacts of tourism on the natural environme nt. Solid waste littering is more common in the case of trekking, rock climbing or hiking tourists. Tourism also pollutes the tourism sites with noise and air pollutions, problems are more compounded in countries or regions which lack or does not have the ability to effectively treat such forms of pollutants generated from tourism activities. Tourism development is more or less responsible for most of the harmful impacts that tourism has on the natural environment. The cutting down of forested areas, changing the landscape etc all have negative impacts on the ecological balance of the tourism destination, whereas levels of impact may vary from site to site, but the negative impacts of tourism on the environment cannot be ignored. The negative impacts are intensely visible in ecologically fragile environments. Whether from generating a new site or a heritage site used for different prospective, somehow environment is getting a hard time by this. By pollution, numbers of persons using limited resources, behaviour of tourists while on holidays and so on are some of the causes which directly or indirectly affects environment. It may include both physical and cultural aspects. Unless managing at all level it is difficult to provide specific consideration to each resource and this is how this becomes a negative aspect towards tourism, environment has to pay such cost by loss to the natural settings to beaches, coral reefs or heritage sites. Effluence caused by tourism main concerns faced by tourism trade today. The sewage waste from tourist resorts are drained into the rivers causing pollution in the river water and eventually to sea bed, it highly affects the marine life. Extreme use of natural resource that is fossil fuel to generate energy for tourist activity, the activities of overfishing, unnecessary use of ground water resources, are only few of problems which are created by tourism industry which in turn causes the reduction of the resource. As tourism grows, it also give hands to increased littering, various forms of pollution e.g. noise, water, air. Sewage and waste got increased sometimes to uncontrollable levels. Alongside need for transportation gets high and number of vehicles produces numerous gases and noise in air. In areas where resources are limited, tourism develops a sense of competition, leading to all sorts of degradation. Such harmful impacts are majorly brought by poor management or lack of proper conservation mechanism in place. Positive impacts: However with all these harmful effects, the environment is also gaining the optimistic outcome of tourism. Tourism is moving towards a sustainable side by helping and preserving the natural resources for the future generation. Various nations and its conservative organisations are implementing strict plans for conserving their flora and fauna and protecting their natural resources. We should not only see at the dark side of the moon if tourism has its costs, its pays back as well, as tourism grows it definitely encourage several other industries to rise side by side. Whenever a destination is selected to develop as a tourism destination government and planning sources put efforts for the regeneration of the place. It consists of revitalisation of an area or a site and beautifies the local environment. Thus this process brings new colours to the site. Any vital site when comes under tourism perspective, its natural resources gets special attention from the managing bodies, where as educated tourism developers knows the value of a natural resource and keeping this in mind they prevent any misuse or damage to it. According to Swarbrooke (1999) the term sustainable tourism can be defined as the approach towards tourism in which more focus is shown in preservation of the natural resources in a way that they can be consumed by the present generation and can be preserved for the future generation as well. Tourism can therefore no longer be seen as a harmful factor to environment. Economically, many areas in the world have benefitted from tourism and conservations are taking place on a higher level in many countries. There is an urgent need to understand the relationships between tourists, tourism and the environment. Many new forms of tourist consumption revolve around environmental quality and the respect for nature. One more reason for the negative picture of tourism might be that it is difficult to disentangle the impact of tourism from other forms of economic activity in certain destination areas. Shaw g., Williams A.M. (2002) Numerous examples and case studies are available where tourism has proven a saviour to drowning economies, along with economical benefits; it is helpful in urbanisation of dead towns. Due to tourism many businesses develop and people get employed, on a social level tourism keeps all communities together and connected. Any tourists social involvement and habits are controlled by the behaviour in which s/he is coming from and an insight can be developed in order to gain positive response from tourists. Appropriate educational information system towards environment is rising as very useful tool. How tourism can enhance environmental conservation- If tourism destroys the environment with negative impacts, it also plays a very big role in the preservation of the natural environment of the destination areas. As tourism industry benefits from the tourism sites, it should be its morally responsible to take a pivotal role in the conservation of the natural setting from which it gets benefits. An appropriate and well managed tourism approach can reduce the pessimistic impact of tourism on the natural environment. Appropriate use of earned revenue- Though the profits earned from the tourism conduct is the major contribution of the tourism trade to the efforts of preservation of the environment, educating the tourist is also an essential aspect in the effort of conservation of the natural environment. The revenue earned from various tourist activities brings in the wealth which enables organisations to focus on the conservational efforts. Without the money, conservation process is nothing. Though, concern must be taken to see that the managers of such destinations or sites are not tempted to enlarge the visitation upper limit as the money starts to flow, thinking that the money thus earned from tourist activities like entry fees will be enough to address the very issues caused by the increased visitation. If this persuasion is not overlooked, than the natural environment will suffer more thereby negating the effective use of money from tourism for the conservation of the environment. The conser vationists who have the expertise and authority should make an effort to take control and focus on the maintenance of the environment. Developing eco-tourism- Another most important method is to bring a change from the basic idea of mainstream conventional tourism. This can be achieved by propagating the initiative of sustainable tourism and eco-tourism which are far more environmental friendly and aims at nourishing both the external and the internal environment of the destination. Adopting the idea of such forms of tourism plays a significant role in the conservation of the natural environment. Fundamental principles of these forms are inclined towards reducing the ill effects of tourism on the environment without compromising the value of experience that the visitors can get from visiting the sites. In further part of this essay I have mentioned and elaborated how this alternate tourism is developing these days. Sound planning- Sound environmental management of tourism amenities like resorts and hotels can enhance the benefits to natural areas; requirement is careful planning of tourism development which is based on the environmental resources existing in the destination area. For example clearing of vast areas of vegetation or forest to build resorts, holiday retreats, etc and changing of the landscape to appear more appealing to the tourist. While doing this, the natural environment or to be precise the biodiversity or the ecology of the area is being affected. So care should be taken to see that tourism development causes least impact on the environment. This again can be done by creating eco friendly resorts or buildings which will have the least impact on the surroundings. Tourism also has the potential of raising awareness of the environmental problems among the people by bringing them into close contact with the surroundings. Tourism cannot be sustainable if the surroundings or the en vironment of the destination is not sustainable in itself. Developing awareness among tourists- Conservationists should offer means by which people using the particular destination, both locals and tourists can be made aware of the importance of maintaining the environment. In fact they can encourage the people to contribute towards maintaining the environmental balance. Conscious effort to transform and develop the destination should be the aim of the environmentalists and the development projects, keeping in mind the positive possibility as well as the downfall of the environment with extreme tourism. A way in which tourism can contribute to the conservation process is by having an appropriate mechanism for the dealing with pollution and sewages generated from tourism activities. Various means can be used to minimise the impact of tourism on the environment. Appropriate interpretation can remove negative facts of the site and educate and inform the tourist on the diverse aspects related to the environment. This can lead to the visitors gre ater understanding of the environment and thus act in a more responsible manner and hence minimise the impact caused by them. Implementation of visitation limits, proper rules regulations and mentioning the environmental issues caused by tourism at its early stage can imply a big difference in the conservation of the natural environment. Helping wildlife preservations- Tourism also plays a vital role in the preservation and protection of various species of endangered species which is a vital part of the natural environment. Nature loving tourists visit wildlife reserves and in doing so contribute to the conservation process. Tourism can play major role in the conservation process in various other ways. The tourism industry can also organise campaigns to raise awareness of the environmental issues affecting nature or wildlife and in doing so can also built up a good image which has been often criticised in the last few decades for the negative impacts it has caused to the wildlife destinations. Alternate tourism is developing- A new breed of tourists is developing called eco-tourists and sustainability came in light in 80s due to previously happened mass destruction in environmental resources. Sustainable Development concept came in attention from 1980s and in March 1980, World Conservation Strategy (WCS) was prepared. IUCN, UNEP, WWF, FFO and UNESCO joined hands for worlds living resources. WCS was a conservation strategy where ecosystem degradation-destruction, deforestation, desertification, pollution, soil erosion and genetic diversity and extinction of species and many related issues were in discussion. The relationship between economic development and the conservation and sustenance of natural resources is concept of sustainable development. Though these thoughts were already in air from many years at that time but WCS discussed many drastic changes happening to environment and WCS was proven as a bridge between prior thoughts and later actions. Another major outcome was establishment of WCED (World commission on environment and development) in 1983, Gro Harlem Brundtland (PM Norway) was appointed chairperson for this commission and in 1987 he publicised a report known as Brundtland Report (Our Common Future) in which Sustainability were originally popularised- Sustainable development is development that meets the needs of the present without compromising the ability of future generations to meet their own needs (According to WCED 1987:43) cited in Hall, C.M. and Lew, A.A. 1998 Certainly sustainability consists of strategy making, preservation of ecological processes, protection of heritage and biodiversity, futuristic focused productivity and balance between social behaviour and environment. Along with the global acceptance of International tourism, sustainability also got recognised as a key element towards long term beneficial policies along with saving limited resources. Destination areas have developed to accommodate all these travellers, and receiving them and catering their needs has also become part of a daily routine. Development is a highly contested concept and since the Second World War debates over what it is, and how to achieve it, has gone through a number of phases. International tourism has been a global phenomenon from centuries, but that packaging of tourism for mass consumption dates back to the mid-19th century, when a specific service sector devoted to the mass consumption of travel emerged, roughly parallel to the development of mass production in the industrial sector. Harrison, D. (ed.) (2001) As people are not tends to be flexible when it comes to implementing rules and regulation, especially when visitors are on holidays, Author B Wheeller describes in his words. And what sort of touristic approach is needed is Tourism at one with nature; non-consumption, non-exploitative, avoiding degradation and destruction of the environment, but rather tourism in harmony, in balance with nature Wheeller, B. (1994) Conclusion Based upon the statements and codes-of-conduct developed by tourism stakeholders, that the environment has been placed on the outline as a major concern of how tourism is to be developed potentially. Thus all these negative and positive effects of tourism on the environment, brings us to a conclusion that tourism can be treated in negative as well as positive aspect in regards to the environment. The negative impacts can be reduced by taking initiative towards conserving natural resources. There are various tools that can be used to protect the environment like collecting income in the form of taxes. All these examples however show us a positive picture about how the tourism industry and the environment are co-dependent to each other for their mutual existence. Though there are many negative aspects to tourism, we can still say that tourism has the tools to protect, preserve and enhance natural resources and the environment. Therefore Tourism and natural environment can both co-exist and be mutually beneficial to each other if the tourism industry has the willingness to pull in full support to the conservation efforts of the natural environment. In doing so, it can help maintain the environment and also recover from the negative image that it has built up for itself during the last few decades. Proper and efficient planning and management accompanied by strict implantation, strict rules and regulations, proper interpretation, propagating the idea of sustainable consumption, well planned eco tourism and sustainable tourism and educating the tourist and making them aware of the impacts of their actions which may have negative impacts on the environment are some of the few ways in which tourism sector can contribute in the conservation process of the natural environment. There cannot be a limit to the extent tourism can contribute to the process and there cannot be an end to its contribution towards environ mental conservation because as long as tourism exists, the negative impacts of tourist will be evident on the natural environment. There is no doubt accepting the fact that tourism brings in money. But even then, care must be taken to make sure that the economic growth brought by the tourism industry must contribute to the natural environment processes and the sustainable use of natural resources. Broken Lives Essay -- essays research papers

Broken Lives written by Estelle Blackburn is an expository text, which through research has presented that nineteen year old John Button was wrongfully convicted of killing his seventeen year old girlfriend Rosemary Anderson in a hit and run. I believe through my reading of Broken Lives that the key factor of expository texts is to explore awkward questions deeply and critically. In this case who was guilty of killing Rosemary Anderson in a hit and run, John Button or Eric Edgar Cooke, and the effect of Cooke’s crimes and murders had on people. John Button was a loving, caring, active and an innocent man. John’s relationship with girlfriend Rosemary Anderson was strong. They planed to get married and Rosemary’s family accepted John for who he was and was already thinking of him as a son in law. â€Å"She was all he could think of: he was in love and was still consumed by the beautiful night at the Skyline Drive-in†. John was caring and always thoughtful of other living things. â€Å"John was upset when he saw the first kangaroo die from Colin’s shot†¦ He was too soft hearted to shoot†. As a child and teenager John loved to keep active by attending ballroom dancing which he was in love with. Button was innocent of killing Rosemary, but fierce police questioning and the police failing to investigate the case thoroughly lead to his imprisonment. There was little physical evidence to prove John’s guilt. â€Å"†¦ looking for blood, flesh or human hair which was likely if the c ar had hit a human...

Influence of Aristotle’s Poetics on William Wordsworth’s Poetry and William Shakespeare’s Plays :: Aristotle Tragedy Tragedies

The Influence of Aristotle on William Wordsworth’s Poetry and William Shakespeare’s Plays Aristotle’s Poetics is not one of his major works, although it has exercised a great deal of influence upon subsequent literary studies and criticism. In this work Aristotle outlines and discusses many basic elements that an author should adhere to in order to write a great tragedies and/or poetry. Two important topics that Aristotle addresses and believes to be crucial to the art work is the mimesis, or imitation of life, and that the audience has an emotional response from the work, or a catharsis. Both William Wordsworth and William Shakespeare were believers in Aristotle’s philosophy concerning tragedies and poetry, and employed these two elements within their works. The basic definition for mimesis is the act of creating an image or images in someone’s mind, through an artistic representation such as, a play, a poem, or a painting, idea or ideas that will then be associated with past experiences. Aristotle is concerned with the artist’s ability to have a significant impact on others. First though the idea or belief that the artistic representation should be occurrences that people could relate to, or experiences that they would be familiar with. William Wordsworth intentions were made clear in the Preface to Lyrical Ballads when he states that a â€Å"†¦poem was to [chuse (sic) incidents and situations from common life, and to relate or describe them†¦ (650)† This mimesis can be seen throughout Wordsworth poem Tintern Abbey. Wordsworth is reflecting upon his memories of the effect that Tintern Abbey had on him while he was away, and describing them to his sister. Wordsworth grew up around Tintern Abbey and with his belief that nature taught humans moral lessons, he was very descriptive in his language describing the landscape and the basic affect that it personally had upon him. Aristotle also believed that the use of simple language in the poetry will keep the ultimate meaning from becoming blurred by complicated figures of speech. Wordsworth basically rejects the ideas of â€Å"personification of abstract ideas (652)† and â€Å"poetic diction (653)† in The Preface to Lyrical Ballads, because his main goal is to imitate the language that the common men speak everyday. Wordsworth’s Tintern Abbey is written in journal style, which is not known for loftiness in speech or complicated language, but for an easy flowing style which employs common everyday language and description. This allows the audience to understand and develop a picture of the image in their mind.

Owning a Pet Essay -- Dog Cat Pets Essays Papers Personal Narrative

Owning a Pet Having a pet is a wonderful idea. Pets bring companionship, personality, and gut wrenching humor to households across the world. Having previously owned both a cat and a dog, and currently being without a pet, I began to think about getting a new furry friend. Born a dog lover, and bred into a cat lover, I had the difficult decision of choosing one of the two. When I was twenty-two years old, I answered an advertisement in the paper for free Labrador puppies. Driving up to the house, I saw all the little critters running around and having a ball of a time. I got into the pen with the pups, and finally decided on the shy runt who spent the majority of his time hiding under a board. I loved his personality and instantly knew he was the dog for me. I named him Charlie, and from that point on our master/dog relationship began. At the time I lived in a small two bedroom house with a fenced yard near Wanamaker road. Once Charlie was a full grown dog, he was the hit of the block. Charlie hardly ever barked, and was always just as happy to see the large groups of children exiting the school bus, as he was for me to arrive at home after work. Charlie had a bag full of tricks. My favorite was the Bob Dole, in which Charlie would sit and shake with his right paw, then I would give him the "Bob Dole" command, and he would immediately shake with his left paw. It was a riot, and netted Charlie about thirty pounds of treats in his lifetime. Vegas, on the other hand, was a full grown Persian cat that a friend was trying to find an adopted home for before she moved out of state. I had been around Vegas enough times to have a good idea of his personality, and I decided to help my friend out and give Vegas a try. Unlike C... ..., and none of it was as impressive or as interesting as the furry cat on the couch, not to mention the personal escort to and from the car to the door from the sweet, polite, black lab outside. But I can't really blame my guests, for Charlie and Vegas' cute faces and gestures worked their magic on me as well. And more times than naught, they got what they wanted in life. After losing Charlie in a car accident, and Vegas being returned to his rightful owner, I decided to get a new cat. A new cat would be more affordable, and fit in with my apartment house lifestyle. The ability to maintain a cats responsibilities while attending school, and spending weekends at work, is far less of a job than it would be for a new dog. The decision has proved worthwhile. Flea is doing well adapting to her new surroundings, and doing her best to avoid the lava life throws her way.

Old Ironsides by Oliver Wendell Holmes: An Explication of the Poem Essay

â€Å"Old Ironsides† is a poem entitled to an old U.S. battleship. After news spread that this ship would be destroyed, Holmes nicknamed the ship as â€Å"Old Ironsides† to help construct a foundation of defense so that this battleship would not be demolished. The poem saved the ship from being destroyed and gave Holmes national recognition as a poet. The first stanza talks about tearing the flag down off the ship because it will no longer sail on the water. The word meteor is used as a metaphor because the ship is an object of attention in the ocean just as a meteor is an object of attention in the sky. The emotional appeal a reader receives from the stanza is loud anger. For example â€Å"Ay, tear her tattered ensign down!† is a line from the first stanza that implies the strong emotion of anger. The second stanza talks about the ship’s past during the War of 1812. The first half is about the ship being a part of a battle. This implies the ship’s importance to the war. The last half of the stanza explains that the ship shall no longer be part of any such venture anymore. The third stanza implies that the ship should not be destroyed but instead active until the ship gets destroyed by an enemy. The stanza also expresses that the ship’s â€Å"grave† should be the ocean.

Pulchara Negotiation

IntroductionThis is paper seeks to analyze and discuss the results of a simulated negotiation between two nations which are Pulchara and Veritas. This researcher represented Pulchara as Deputy Foreign Minister of Economic Affairs to negotiate with the Diego, as the First Secretary for International Legal Affairs from Veritas on issues of compensation caused by damaged to Pulcharas’ farmers crops caused by a chemical pesticide DS-30 leakage from a chemical plant in Veritas that had adversely affected large tracts of Pulchran farmland. After the negotiation, there is a good ground to now have analysis whether there is basis to sustain of the application of tools that this researcher has learned in class to a deeper understanding of the negotiation. The analysis therefore basically as ask reason for the working of negotiation tactics employed in the case and wells as the finding the reasons for the partner having been able to set the frame more effectively than me.Using evidence o f what really happened in the negotiation as well valid references; this paper will try to revisit what happened in the preparatory phrase including the sort of preparation and what strategy did developed.   Included also are the applications of the concept of BATNA, target point, resistance point, position, interest and positions, anchors   during   entry phrase. In addition, discussion extend to framing preferred and applied by the parties, shaping the end game after the first agreements and whether special topics on culture, gender power, personality, communication, or other thematic issues did play in the negotiation.  Ã‚   A conclusion on the analysis made will form to end the paper. The preparatory phaseAt the preparatory phase, I needed to know what I wanted to have for my country and that is to compensated by Veritas within an amount I believed that is fair enough within a certain predetermined range of figures.   As the representative of Pulchra I approached this n egotiation with a Calculus-based trust. I depended on a history of cordial relationship with the Veritas and hoped they will reciprocate. I felt as if I did not have a great BATNA, because winning the election was main concern, and it can only happen if Diego of Veritas spills out the money. I went in with my Resistance Point at 50 million and Optimal point at 100 million.I found my negotiation with Diego very peaceful and respectful. I ran into a trouble when I could not explain why we cannot export the damage crops in a time of emergency. I have explained to him that the crops were destroyed by the farmers according to our legislation. He argued that they could have been exported to other part of the parts of the world, and our policy states no import over 4ppm.Diego stated that he can only compensate for the 300,000 mt because it went over 12ppm. I could not get him to come to 800,000mt. I became a little forceful and expressed signs of disrespect when he offered 300,000mt for 12 5/mt which comes at 37.5 million. Showing signs of a salesman, he offered 500000mt for 125/mt expressing that the farmers are interested in their inflated price of 125/mt, and agreeing to this agreement will make all of us happy. He explained deal comes out at 62.5 million and knowing that congress will reimburse them will 50 million which will come out as 112.5 million, this being over their original demand of 100 million.   I guess Diego knew that I do not have a good BATNA and that he knew that what is important to me is that I got the farmers compensatedThe use of BATNAMy BATNA (Spangler, 2003) was to walk out of the negotiation is to bring the complaint of the farmers to the international courts and have Veritas pay the higher or actual amount if the Diego will not agree within my Resistance Point at 50 million and Optimal point at 100 million USD. Veritas’ BATNA was clear as Diego was able to parlay on the table ways to expand the pie when he has sensed that I was los ing respect when he started his offer to paying 300 mt at about 37.5 million USD.   Veritas’ side was able to anchor on his belief that my government would be ready enough to give 50 million USD from the act of legislature. The use of framingAs to the use of framing by either side it may be stated that the other side’s preferred frame is the further expanding the pie as Diego saw my limited options. With his knowledge that I am interested to have that $100M   as compensation of the damage for $800M, he as was brave to say that I could get the part of the amount the from my government. I know that knowing the interest behind my position (Fisher and Ury, 1981) taken is more important in negotiation. This I came to know after I have revealed the experience of a country who found it difficult to pay after they found the effort was not made to have the commitment of the responsible country to have at least promised some compensation.   I realized telling Diego a part of my BATNA world worse than it should have been. This happened because Diego perceived that my BATNA is worse than I thought. He used power in the conflicts (Coleman, 2000).Between the two of the negotiator I feel Diego was more persuasive since he seemed to have prepared more for the negotiation up to what level I would be anchoring the negotiation. He seemed to know my asking price. Since his country is basically admitting responsibility he was in a sense to be finding the best criteria to base this country’s liability.   I found that I basically told him what is my interest and he seemed to have read it easily and thus the negotiation was not as difficult as I had expected. The main negotiationAs to the main negotiation, it may be asked: What tactics were used by both sides? Was it more collaborative or competitive (or did it switch over the course of the negotiation, and how)? Why were these tactics effective or not?In response to the questions, I guess both of us applied the collaborative approach (Weber, and Khandemian, 1997; Meiners and Miller, 2004) as I started with the negotiation by approaching this negotiation with a Calculus-based trust. Having depended on a history of cordial relationship with the Veritas and with my big hope that they will reciprocate, I actually set the stage for a very collaborative instead of competitive one. This researcher believes that the tactics employed were effective enough because we chose to expand the pie instead of taking a hard-line position in the negotiation. I was looking forward to the election of the President of my country and who continued stay will also keep my long-term in office as government official and a representative of my country on issues of international dealings like the negotiations I had.As to endgame stage of the negotiation, the following questions   may be asked:   Once we had some agreement on the main points, or a `first agreement`, how did the remaining points shape up, and wha t brought us the negotiators to the final deal? Did we try any `nibbles` or other tactics in this phase? How well did they work? What has kept the negotiation proceeding well, I believe, is based on our giving much importance to our relationships is friends and this has led the negotiation proceeding almost very smoothly. With Diego understanding the destruction of the farmers would be important to my country and his country’s readiness to respond to the need by ad admission of the result of the damage, the issue was more the amount of the compensation. We conducted the negotiation in a relatively peaceful and friendly environment where we feel we could just make thing free flowing.   Diego as I said has the marking of salesman since from his offer of compensating only 300,000 metric tons of the crops which had effectively raised by blood pressure because the amount of compensation would be below my walk away price of 50 million, he was magnanimous and friendly enough to brin g it into 500,000 and thereby sending the amount of 62.5 million USD.He capped it by saying that 50 million could be coming from my country’s legislature and that would exceed the 100 million being demanded by the farmers.  I guess, there is wisdom in what Diego did in jumping from 300,000 metric tons to 500,000 tons as a sign of building greater business relationship   with the offer of buying the my country’s farmer’s products for the next five years.   Diego again I suppose know my BATNA and he sensed that my country’s farmers have limited options where to sell the products.Although a bit satisfied, I felt I should fish for more damaged crops. I insisted that he should compensate for the damage of at least 600,000 mt for the market price of 115/mt. I tried to cajole him into our friendship in the past and that I have to explain the farmers why I cannot compensate for more of damaged crops. They complied according to our law and damaged crops is 8 00,000 mt not 500,000 mt, which you party is culpable of. He was resolute about his offer, but did bend a little by offering to buy more crops from us in the future, which came about 5 years agreement. I could not set the price of future crops with him due to shortage of timeThe relevance of culture, gender power, personality, communication, or other thematic issues in negotiationAs to whether culture, gender power, personality, communication, or other thematic issues play in this negotiation, I believe they have played a part to the extent how one negotiator feels about the other.   Diego’s personality was that of sales man and so was I. We felt there was better reason to agree on many things despite the conflict than walking out of the negotiation.ConclusionTo conclude, it may be stated that I felt if I was a little aggressive in the beginning and showed more of a concern about the election, and Verities has no option but to help us out with 100million. By expressing that it is in both Presidents’ interest that we win the election and dictating that there will be no compromise in the 800000mt damaged, especially from a friendly nation. Most likely my deal would have closed with much higher offer than 62.5 million. I still would not have a threat approach, by challenging them to the Nuclear charge. I feel cooperative approach is the only way to go.This experience has also proved to this researcher the importance of frame, the significant role played by having BATAN, anchoring one’s argument of what may deemed fair that could further expand the pie as well the greater benefit in collaborative negotiation rather a competitive one.References:Coleman. Gay Marriage: The Controversial Issue Essay

Gay marriage has been an ongoing controversial issue. Many other countries have legalized gay marriage for decades and the United States is just beginning to pick up on the trend. While many people believe that gay marriage will stem many problems in both the short run and the long run, it is an issue of discrimination if we were to put a law banning gay marriage. Currently the United States are split up with some states supporting gay marriage and others that do not. There are 19 states that have legalized gay marriage and there are 31 states that have made gay marriage illegal. While those who oppose gay marriage have their reasons, those reasons are unjust and an infringement on the rights of the citizens of the United States. We are the land of the free with the right to the pursuit of happiness. There are many issues concerning the banning of gay marriage. We the people are protected under the First Amendment of the Constitution which states that the people’s religious views are protected. Haters of gay marriage claim that marriage is sanctioned by the church and that it is a sin in regards to their religion and their bible. But that is exactly the point. In the United States we are a diverse community. There are so many different religions in the United States that we have cease to acknowledge just one religion, in fact, we have never just acknowledged just one religion. Using the church and the bible to outcast gay marriage is an act of discrimination and a violation to those people’s individual rights. History has proven that acceptance of minority groups has led to a more unified nation where people from different ethnicity or culture can mingle together in one society. The issue of slavery has been handled and now African americans co-exist with our societ y just like any other person. The issue of interracial marriage has been handled and now there are happy families with different cultures living a normal life just like anyone else. What gives anyone the right to claim that gay marriage won’t yield the same result? There are also benefits that married couples have that gay married couples do not have when their marriage isn’t recognized. Marriage status affects many things such as tax filing status, joint ownerships in property, insurance benefits, and  critical medical decisions. Some people argue that people may take advantage of this situation by abusing the system to gain benefits for themselves. That may be true, however, how can you deny those who legitimately want the benefits because they are truthfully married without a second hidden agenda? If one member of the couple had a serious medical emergency and needed their spouse approval for a surgery what would happen if they were not allowed to make that decision? It’s unfair to deny gay married couples their right to the benefits we have because people don’t approve of them. These people want to live a normal life just as much as we do. In fact it is not their chose that they have to live this way. Studies have evidence that homosexuality is caused by biological reasons. During fetal development there are switches that trigger which impacts sexual development regarding their sexuality and other various sexual characteristics such as masculinity and femininity traits. Individuals in gay couples have either stronger masculine or feminine characteristics due to this. People with medical disorders are also born in this exact way so why do we discriminate against gay couples? They did not choose to be born this way. They just were. If we discriminate against gay couples then we might as well discriminate against everybody with medical disorders as well. If you think about it, our society provides an undesirable living condition for gay couples. People make fun of them; gay bashers beat people up, and many other cruel things. Why would people choose to live that lifestyle if they could help it? These people cannot deny their true nature and we are discriminating on them because of it. One of the most important reasons why gay marriage should be allowed is because marriage is about more than just a title of two people being bounded by law. Marriage is the ultimate expression of love between two people who want to live the rest of their lives with the person they love the most. Marriage is a sacred concept that is the ultimate form of love. We allow a man and a woman to express that symbolic nature of love, therefore, it is unfair to deny gay couples the right to express their love as well. A man and a woman are not the only two entities that can love each other. A man and a man or a woman and a woman can love each other just as much as a man and a woman can. What some gay couples will do is go to a state that has legalized gay marriage and get married there. Then if they go to any other state the state has to recognize their marriage because of the Full Faith and Credit Clause  protected by the Constitution. Therefore, there is a massive loop hole in the system, however, one that is protected by our federal constitution. Other loop holes in society are abused and fixed because it is against the law. But in this case, the loop hole is protected so why should we even deal with the hassle it causes? If people can get around the system through this method then we should just legalize gay marriage overall. If people are willing to go through all the trouble just to get their marriage recognize why do we have to cause so much hassle for them when technically the process is protected by the constitution? It feels like the people are trying to put so many restrictions on gay marriage in hopes that we will succumb to the pressure and give up. But if its regarding the peoples individual rights as American citizens we should stand up and fight in what is right. The north fought against slavery because they believe it was the right thing to do. Look how much that effort has yield in the present day. Racism has died down to a minimal and we are all able to coexist and accept one another in one society. Another issue that is controversial is the upbringing of children in gay couples. They argue that children should have a father figure and a mother figure for the best upbringing possible. However, what measures a person’s ability to raise a child? Two men or women could raise a child just as well as a woman and man can. We are placing assumptions that they would not be capable to raise a child well. Some people argue that children would not be able to develop in a normal way growing up. But if we take a look at factors that could contribute to the possible hardships of these children, society itself places hardships on these gay couples. These children of gay couples get picked on because society outcasts people with gay parents. Society enables people to view gay couples different. If society accepted gay couples then these children would be able to endure their childhood growing up without any extra hardships. It is unfair to make claims that children are affected by gay ma rriage when we cause problems ourselves. How can we really know if gay marriage affects children before we stop bashing on gay marriage? Another issue with gay marriage is the claims that divorce is higher within gay marriage couples. Massachusetts was the first state to legalize gay marriage in 2004. In 2008 it had lowest divorce rate in the country. And between 2003 to 2008 its divorce rate had declined by 21 percent. Divorce happens to everybody including between a man and a woman.  People are claiming that gay marriage have high divorce rates when it is not necessarily true. Anybody who targets a specific group will notice their statistical facts more than the general society when in reality its not different than everybody in general. Also the divorce rate should not even be an issue. Why do people divorce in the first place? It is because they are not happy with their partner whether it be they were unfaithful or they were not the ones for each other. Regardless, people divorce because they have not found their true happiness with their partner yet. And there is no difference between a man and a woman divorcing for those reasons versus two men or two women divorcing for those reasons. It is the people†™s right to divorce just like any other issue we frown upon or do not approve. American needs to stop discriminating against issues that are not pertinent to the well-being of society and focus more on issues like crime, poverty, and foreign policy issues. Gay marriage should be allowed in all states. A lot of issues would be solved if this was the case. America has fought over and over to protect the minorities against the majority. We are a nation of the majority, but protect the minority. That is why people from around the world want to come live in the United States. We are fighting against what we symbolize as a nation and it is hypocritical to our actions in the past when we fought against slavery or interracial marriages. If we take a look at other countries that have legalized gay marriage for decades there has not been any issues in those countries. People fear that gay marriage will upon the gates for other marriages such as incest marriage, marriage to animals, and so on. But our fellow countries who have done it for longer than us have not encountered such problems. It is not fair to act on assumptions which we do not even know will happen and infringe on the rights of American citizens to pursue their own happiness in gay marriage. Our constitution and bill of rights protect us and enable us to chase our dreams. Fighting against gay marriage is fighting against the law we have fought and protected for centuries. Gay marriage should be legalized on a federal level and the states should not have the right to control whether or not gay marriage is legal or banned. Just like how there was an amendment passed to stop the discrimination against blacks gay marriage should be treated the same way.  There is no difference between the two. Stop with the discriminating and lets come together as a whole society. Miranda v. Arizona Essay Example | Topics and Well Written Essays - 1750 words

Miranda v. Arizona - Essay Example The Arizona Supreme Court convicted and sentenced Miranda to 20-30 years imprisonment, based from his written confession. Later, the U.S. Supreme Court repealed the conviction and ordered the suppression of Miranda’s signed rape confession (Mason & Stephenson, 2007). The Court ruled that â€Å"the prosecution may not use statements, whether exculpatory or inculpatory, stemming from custodial interrogation of the defendant unless it demonstrates the use of procedural safeguards effective to secure the Fifth Amendment privilege against self-incrimination† (Warren, 1966) and the Sixth Amendment right to a legal counsel (Mason & Stephenson, 2007). This rule is what is now famously known as the ‘Miranda Warning.† This paper will discuss the Miranda v. Arizona Case; show how it violated the Fifth and Sixth Amendments of the Constitution; and tackle how the 1966 U.S. Supreme Court’s Miranda decision transformed the American judicial system. Critical analysis by this author will likewise be given. Miranda versus Arizona In 1963, Ernesto Miranda, a young, destitute and uneducated migrant from Mexico, was arrested by the Arizona Police for crimes of kidnapping and rape. ... The written confession was used in the trial. He was convicted of kidnapping and rape crimes and sentenced to 20-30 years imprisonment for each crime by the Arizona Supreme Court (Baker, 1985). Miranda’s legal defense appealed to the Arizona Supreme Court and revealed reasonable doubt regarding the elements of the said committed crime: the rape victim was unable to show evidence of resistance to Miranda during the said sexual assault; it was questionable if Miranda had fully understood his legal rights and had indeed â€Å"voluntarily† waived them. His lawyer disputed that the written confession should not have been allowed in the trial since he was not afforded appropriate protection to his rights as mandated by the U.S Constitution and the U.S. court laws (Gribben, 2011). Two years after, the U. S. Supreme Court overturned the conviction and ordered the inadmissibility of the signed confession. The Court ruled that the defendant should be fully knowledgeable of his ri ght to assistance of a legal counsel before or during the interrogation; aware of his right to remain silent; and reminded that any admitted statement may be used against him. The Court explained that police interrogation procedures are intimidating and could forcefully compel the individual to self-incrimination, especially without a defense lawyer present during the interrogation (Hendrie, 1997). Violation of the Fifth and Sixth Amendments of the Constitution The Fifth Amendment (right to self-incrimination) and the Sixth Amendment (right to the assistance of a defense counsel) are the legal privileges guaranteed to all individuals by the U.S. Constitution. Any confession made by an individual is inadmissible in court if it
